Clown Video Damaging to Case

For those of you who have not seen the entire “Clown Video” yet, it will be upsetting. Poor Anna, OMG.

Howard is finally being seen for what many suspect he is. This tape was released by The Los Angeles Superior Court. Howard Stern is filming Anna as a friend’s daughter, Riley Shelly – a nine year old, paints Anna’s face with clown makeup. Anna is pregnant in this tape but is so out of it that she is unaware of the fact. She is so messed up that she mistakes a doll for her baby.

Riley tells Howard that Anna has “brain trouble” — Howard is a very disturbed individual to film something like this in the first place, but to involve a young girl in his ploy is quite reprehensible. Howard’s defense is that Anna staged this video, she is acting – as if! This is a damaging piece of evidence in his criminal trial.

Finally, The Court Case is Moving Forward

Well folks, Larry and the Doctors are finally getting their say in court. Apparently, the case is being heard to determine if there is any need to proceed any further in the matter of Anna Nicole’s death and the over-prescribing & enabling of her (now alleged) drug habit.

Big Moe, Anna’s former bodyguard, tells the court that he saw Howard K. Stern load a syringe with crushed up valium but he didn’t actually see Howard inject Anna. Howard has not been able to move on since Anna’s death and now lives with his parents. In the video below it is stated that the Hard Rock Cafe called the doctor, however, Howard canceled it because he didn’t want the publicity.

The whole premise of the accused defense is that Anna had a lot of health issues that were addressed by her doctors and everyone around her who even attempted to delve deeper into her ever increasing “drug use” was informed that all the drugs were prescription drugs, therefore, it was Okay! All of her friends, doctors, boyfriends easily gave into her request for more and more because they trusted the judgment of her doctors. Therefore, no one is guilty of anything other than trying to help her. All I can say is please don’t “help” me if I beg.

I must be weird because I grew up with the understanding that if someone busted their “chops” trying to get you to quit something that wasn’t good for you it was an act of kindness. They willingly took your “guff and abuse” because it was the right thing to do. It was their duty if they cared at all for you. It was when they gave into your every whim that showed a total lack of caring and love.

I teach my grandkids that if I take the time to punish and scold them that I am showing them “I care.” It takes a lot of energy to do this and if I didn’t care I wouldn’t bother. It is much easier to just ignore it and hope that it goes away. Maybe I have it wrong and Howard has it right. Who am I to say?

Prosecutors said Anna was prescribed huge amounts of pills, from even when she was pregnant. They equated that to giving a loaded gun to someone that is suicidal and saying “Be careful, don’t pull the trigger!”

Surprise, Surprise! Howard K. Stern and the Doctor’s Plead Not Guilty

Howard K. Stern and two doctors Khristine Eroshevich (a personal friend of Anna’s) and Sandeep Kapoor, plead “not guilty” on May 13th to a slew of charges (11 to be exact) in the Anna Nicole Smith drug case. The case where Howard K. Stern is accused of conspiring with two above mentioned doctors to give “known addict” Anna Nicole Smith hundreds of prescription drugs in the months before her fatal 2007 overdose.

“These individuals repeatedly and excessively furnished thousands of prescription pills to Anna Nicole Smith, often for no legitimate medical purpose,” California Attorney General Jerry Brown said in a statement earlier this month. “This case is not a minor league case. Thousands of pills were put into the body of Anna Nicole Smith. The maximum sentence is several years, one count could be as high as three years, and there are 11 counts.”

The three were charged last month, following a raid on Dr. Kapoor’s Studio City, CA, office. Of note is the fact that this was not the only raid done.

The Los Angeles County District Attorney’s office confirmed that authorities raided six locations previously, including the offices and residences of two of Smith’s former doctors, psychiatrist Dr. Khristine Eroshevich and physician Dr. Sandeep Kapoor. All 11 prescriptions found in Anna’s Florida hotel room after her accidental overdose were written by Dr. Eroshevich, 8 of which were in Howard K. Stern’s name.

Howard K. Stern, Dr. Kapoor and Dr. Eroshevich face a potential of 33 years behind bars, according to Brown.

So try to pretend you are surprised and didn’t see that plea coming.

Apparently Howard and one of his attorneys, Steven Sadow, feel that the charges don’t really apply to him because he is not a health care provider. Stern’s attorney previously said he will “ultimately be exonerated.”

“He’s not a doctor,” Sadow said. “He’s not signing prescriptions. That’s the nature of the charge, and we’re debating it.” “We have nothing to hide,” Sadow said. “We have no problem whatsoever giving them all the handwriting they want.”

So the prescriptions themselves will be analyzed for all parties to determine who wrote what, when and to whom. This will aid the judge in determining whether to proceed or not. It will also aid in determining if all three accused are equally responsible or if they will have different sentences.

Howard will return to court on June 8 to challenge the charges filed against him. If the case moves forward, the judge will set a date for a preliminary hearing, which attorneys expect to last more than two weeks.

We will have to wait this one out for now. If it does go to court it should prove to be a very interesting and informative case.
